A Will or No Will


When it comes to estate planning, the three questions I typically hear are:

  1. how to write a will
  2. how to ensure that property is likely to end up in the “right” hands
  3. how to manage the “German” issues such as child custody for minors, assets in Germany etc.

After I provide answers or send them our questionnaire often I hear … nothing! As if the fact to write a will will shorten their life span.

This leads to the question: What happens when a person dies without a will? Under German law and for example North Carolina law there are provisions known as dying “intestate” or “gesetzliche Erbfolge“, which is a way to distribute assets and to take care of minors.
